This Employment Agreement (" Agreement") is entered into on August 12, 2017 (" Execution Date"),
BY AND AMONGST
Shally Corps , Private Company , duly incorporated and registered under the Companies Act, 1956/2013 (as applicable), and having its registered office at Wall Block Street , Mumbai , Maharashtra - 560012 (hereinafter referred to as the " Employer", which expression shall, unless it be repugnant to the context or meaning thereof, be deemed to mean and include its successors and permitted assigns);
Wally Smith , and residing at Mega Street , Delhi , Delhi - 110010 (the " Employee").
Each party above named shall be referred to as a " Party" when referred to individually and shall be referred to as the " Parties" when referred to collectively.
In this Agreement , unless the context otherwise requires, references to one gender include all genders and references to the singular include the plural and vice versa.
WHEREAS, the Parties hereto desire to enter into this Agreement to define and set forth the terms and conditions of the employment of the Employee by the Employer ; NOW, THEREFORE, in consideration of the mutual covenants and agreements set forth below, it is hereby covenanted and agreed by the Employer and the Employee as follows:
The Employee will be employed on the following basis: full-time.
2.1. The Employee 's employment with the Employer (" Employment") shall be effective from the " Commencement Date" , which shall be the later of:
2.1.1. August 02, 2018; or,
2.1.2. The Employee providing the Employer with copies of the his/ her passport or birth certificate and all documents pertaining to his/ her educational and professional qualifications and references from his/ her previous employers (if any) to the Employer 's satisfaction.
2.2. The Employee shall be employed with the Employer as Product Designer . The Employer reserves the right to change the Employee 's designation from time to time at its sole and absolute discretion.
2.3. The Employee 's period of continuous Employment with the Employer shall be calculated from the Commencement Date .
2.4. The Employee warrants and represents to the Employer that the he/ she will not breach any obligation binding on him/ her by reason of entering into this Agreement or performing any of his/ her duties and obligations under it or other third party contractual obligations.
2.5. The Employee warrants that all the information relating to him/ her and provided by him/ her to the Employer is true and accurate.
